THE 10 GOLDEN RULES (SUMMARY)

  1. Adults only: MyXSide 18+, COCOON entry 21+ (ID required).
  2. Privacy first: discretion is mandatory.
  3. No photos / no recording inside COCOON.
  4. Always ask first. Consent is required; no means no.
  5. Respect boundaries. No harassment or pressure.
  6. Follow dress code, signage, and staff instructions.
  7. No drugs. No solicitation / payment for sex.
  8. Safer sex encouraged; respect safer‑sex boundaries.
  9. Your card/account is personal—do not share credentials.
  10. Violations can lead to removal, bans, and up to €10,000 contractual penalty for severe breaches.

1. Scope and priority

  • These Standard Terms apply to (i) visits to COCOON club and COCOON events, and (ii) use of the MyXSide online community and related services (together, the “Services”).
  • The Services are operated by NightBerry OÜ (registry code 16939788), address Tartu mnt 16, 10117 Tallinn, Estonia (the “Operator”, “we”, “us”).
  • These Standard Terms are incorporated into the MyXSide / COCOON Master Agreement signed during verification.
  • Event-specific rules, on-site signage, and staff instructions may add to these terms. If there is a conflict, on-site rules and staff instructions prevail for immediate safety, privacy, and venue operation.

2. Adults only: age limits, verification, and admission

  • MyXSide is for adults (18+) only.
  • Entry to COCOON club and COCOON events is 21+ and requires a valid identity document for age and membership verification.
  • Admission is always at the Operator’s discretion to protect safety, privacy, and the atmosphere of the venue/community. We may refuse entry or remove a guest even after admission.
  • Venue capacity, opening hours, dress code checks, and security requirements apply. Entry may be delayed or refused if capacity is full or rules are not met.
  • You must follow the verification process and provide accurate information. Misrepresentation is a serious violation.

3. Identity, alias, and contact details (your duty of care)

  • You may use an alias/username publicly. Your chosen email address is your unique identifier for MyXSide services.
  • You must keep your email address working and reachable. If your email bounces or is non-functional, we may suspend or cancel access/benefits until updated (and may invalidate associated cards/credentials).
  • You must keep your phone number and other contact information accurate and up to date.
  • You are responsible for all consequences caused by inaccurate details, including missed notices, denied entry, or security actions.

4. Security of your account and digital card (non-transferable)

  • All membership benefits, event access, and digital credentials (including MyXSide card/QR codes, invite codes, and account access) are personal and non-transferable.
  • You must keep credentials confidential and protect them from loss, theft, copying, or misuse.
  • If you share credentials (intentionally or negligently), you are responsible for any resulting entry, purchases, bans, damages, or other consequences.
  • Door access via digital card is a convenience feature and not guaranteed to work at all times. You must still comply with opening hours and check-in procedures.
  • Notify us immediately if you suspect compromise, loss, or misuse so we can restrict access.

5. Privacy & discretion (core rule)

  • COCOON and MyXSide are privacy-first. Treat all identities, faces, voices, messages, and encounters as strictly confidential.
  • Do not expose, dox, threaten exposure, stalk, or attempt to identify members outside the community or venue.
  • Do not share information about other guests’ presence—online or offline—even indirectly or by “hinting”. Speak only impersonally.

6. Strict NO RECORDING / NO PHOTOS policy

  • Inside COCOON and at COCOON events: NO photos, NO videos, and NO audio recording.
  • Phones may be collected, sealed, or restricted at reception to enforce privacy.
  • Any exception requires prior written authorization from the Operator AND explicit consent from every identifiable person.
  • Attempted recording, hidden devices, or distributing captured content is treated as a severe breach.

7. Consent, boundaries, and respectful interaction

  • Always ask first. Consent must be clear, voluntary, and can be withdrawn at any time.
  • No means no. If you are declined, stop immediately and do not continue to pursue.
  • No consent by assumption (including based on clothing, flirting, or being in a lifestyle venue).
  • If someone appears impaired or unable to consent, treat it as no consent. If needed, notify staff.
  • We recommend partners discuss boundaries before arrival and use a private check-in phrase/cue if needed.

8. Zero-tolerance: harassment, coercion, discrimination

  • No harassment, intimidation, bullying, coercion, blackmail, threats, or unwanted sexual attention.
  • No hate or discrimination of any kind (including racism, sexism, homophobia/transphobia, or degrading language).
  • Rude, aggressive, or unsafe behaviour may result in immediate removal and/or bans.

9. Alcohol, impairment, and safety

  • We may refuse service of alcohol and/or remove any person who is visibly intoxicated or otherwise unable to behave safely.
  • Do not pressure others to drink or consume anything. Never tamper with another person’s drink.
  • If you feel unwell, unsafe, or suspect drink tampering, contact staff immediately.

10. COCOON venue etiquette (practical rules)

  • Dress code applies: “Dress to impress.” Men: polite clothing. Women: sexy, classy attire or lingerie. No sportswear, shorts, or t‑shirts where prohibited.
  • Couples who arrive together must stay and leave together (unless staff confirms an exception for safety).
  • No drinks in playrooms.
  • No shoes in relax/bed areas.
  • Be hygienic: use showers as needed and clean up after yourself. Use provided bins.
  • Smoking: only in designated areas (typically vapes/e‑cigarettes only). No smoking in front of the door if prohibited.
  • Play/sexual activity (if any) is allowed only in designated areas and only with consent. Respect all signs, room rules, and staff directions.
  • If you meet an unexpected acquaintance, handle it discreetly and respectfully; staff can assist if needed.

11. Safer sex & health

  • We recommend safer sex practices, especially with new partners.
  • We may provide condoms and lubricants; use what you need.
  • Do not request, pressure for, or promote unprotected sex. Respect others’ safer‑sex boundaries.
  • You understand we cannot guarantee other guests’ health status. You are responsible for your own decisions and risk management.

12. Prohibited conduct and illegal activity

  • No drugs (use, possession, buying, selling). Serious cases may be reported to authorities.
  • No soliciting or offering paid sexual services, and no “sugar” arrangements or payment‑for‑sex discussions on MyXSide or at COCOON.
  • No weapons, theft, fraud, vandalism, or deliberate damage.
  • No impersonation, scams, or misleading profiles. One person may hold only one account unless explicitly approved.

13. MyXSide online community rules

  • Be respectful: no drama, no stalking, no harassment, no threats, no extortion, no outing.
  • Use your official alias. Fake profiles, duplicate accounts, and scams are not allowed.
  • Keep it classy: no trashy behaviour, explicit pornographic content, or aggression.
  • Share responsibly: upload only content you own or have permission to share; never post others’ private content without consent.
  • No illegal content. No content that promotes violence, hate, or non-consensual behaviour.
  • No spamming or unauthorized advertising/promotions.
  • We do not routinely monitor private messages; however, we may access platform data when necessary for safety, legal compliance, or investigation of serious violations.

14. Property, valuables, and damage

  • Bring valuables at your own risk. The Operator is not liable for loss or theft of personal items to the extent permitted by law.
  • If you damage the venue, furniture, equipment, or other guests’ property (intentionally or negligently), you are liable for the damage and related costs.

15. Reporting and evidence

  • If you feel unsafe or witness a violation, contact staff immediately (on-site) or email us.
  • To investigate, we may ask for message links, screenshots, timestamps, or other proof. Timely reporting helps us act quickly.
  • False or malicious reports are a violation.

16. Enforcement, suspension, and bans

  • Depending on severity, we may: warn, restrict areas/features, remove you from the venue/event, suspend access, terminate the Master Agreement, and/or impose a permanent ban.
  • Staff decisions for immediate safety/privacy are final in the moment.
  • Where applicable, entry fees or event tickets may be non-refundable if removal is caused by your rule violation (subject to mandatory consumer law).

17. Contractual consequences for privacy breaches

  • Privacy breaches create severe risk for guests and the Operator.
  • For violations of confidentiality/no-recording rules or serious misconduct, we may demand liquidated damages/contractual penalty up to EUR 10,000, proportionate to the breach and to the extent permitted by law, and/or seek compensation for actual damages and legal costs.

18. Data protection summary (read the full Privacy Policy)

  • The Privacy Policy and data processing terms are published on the official MyXSide and COCOON websites and are also available on-site before entry.
  • For MyXSide, your email is used as your unique identifier. No additional personal data is required to be sent to the website during verification.
  • Identity-code data is stored separately for security screening and to prevent unwanted persons; paper agreements may be stored securely by the Operator.

19. Changes to these Standard Terms

  • We may update these Standard Terms to protect safety, comply with law, or improve clarity.
  • The latest version is always published in the official locations and available on-site before entry.
  • Continued use/attendance after the effective date means you accept the updated version.

20. Governing law and disputes

  • These Standard Terms are governed by the laws of Estonia.
  • Disputes are handled first by good-faith negotiation; if unresolved, disputes may be brought to the competent Estonian court, unless mandatory consumer law requires otherwise.

If you do not agree with these Standard Terms, do not use MyXSide or enter COCOON.
